Terms of Service

These terms are an agreement between you and Pickd covering the Pickd mobile app and this website. By joining the waitlist, creating an account, or using the app, you accept them. If you don't agree, please don't use Pickd.

What Pickd is

Pickd recommends films and television based on answers you give it and the streaming services you tell us you subscribe to. It is a recommendation tool. Pickd does not stream, host, or provide any video content, and it does not give you access to anything you aren't already paying for.

Beta

Pickd is in beta and free to use during that period. Beta software is incomplete: features may change or disappear, recommendations may be wrong, and we may reset data between builds where that is unavoidable. We'll give notice before anything destructive where we reasonably can. We may introduce paid plans later; if we do, we'll tell you before you're charged for anything, and you'll never be charged without opting in.

Don't do any of the following:

Group sessions

When you start or join a group session, the other participants see the picks that result and the fact that you took part. Don't invite people to a session who haven't agreed to join one.

Content and third parties

Film and television metadata, including artwork and ratings, comes from TMDB. Streaming availability comes from JustWatch. Pickd is not endorsed or certified by TMDB or JustWatch.

Pickd is not affiliated with, endorsed by, or sponsored by Netflix, Hulu, Max, Disney+, Prime Video, Apple TV+, Paramount+, Peacock, or any other streaming service. Their names and marks belong to them and are used only to describe where a title can be watched. Availability changes constantly and is sometimes wrong; your subscription and viewing are governed by that service's own terms, not ours.

Our rights in Pickd

The app, this website, the Pickd name and logo, and the recommendation system behind them are ours and remain ours. These terms grant you a personal, non-exclusive, non-transferable, revocable licence to use Pickd for your own non-commercial use. Nothing more is implied.

Your content

Your taste answers, seen list and preferences stay yours. You grant us only the licence needed to run the service — to store that data, generate your recommendations, and produce aggregated statistics that do not identify you.

Ending things

You can delete your account at any time from Settings in the app. We may suspend or terminate an account that breaches these terms, or if we stop offering the service. If we terminate your account without cause, we'll tell you by email where we can.

Disclaimers

Pickd is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that recommendations will suit you, that availability information is accurate or current, or that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, Pickd is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the service. Our total liability for any claim relating to Pickd is limited to the greater of the amount you paid us in the twelve months before the claim, or 50 USD.

Some jurisdictions don't allow these exclusions. Where that's the case, they don't apply to you, and nothing here limits liability for death, personal injury, fraud, or anything else that can't lawfully be limited.

Indemnity

You agree to indemnify Pickd against claims arising from your misuse of the service or your breach of these terms.

Apple App Store

If you got Pickd from the App Store: this agreement is between you and Pickd, not Apple. Apple has no obligation to provide support or maintenance, and is not responsible for the app or any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes

We may update these terms. If a change is material, we'll update the date above and give notice in the app or by email before it takes effect. Continuing to use Pickd after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts located there, except that either of us may bring a claim in small claims court. If any provision is held unenforceable, the rest stays in force.
